1. Acceptance of These Terms

Welcome to FossilRadar.

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and the independent developer publishing FossilRadar under the developer name NextGen Labs ("FossilRadar," "we," "our," or "us").

These Terms govern your access to and use of:

• the FossilRadar mobile applications;
• the FossilRadar website;
• all associated online services;
• premium subscription features;
• artificial intelligence identification services;
• geological forecasting services;
• and any future services that reference these Terms (collectively, the "Services").

By downloading, installing, accessing, creating an account, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree with these Terms, you must immediately stop using the Services and, if applicable, delete your account.

2. Who We Are

FossilRadar is operated by an independent software developer publishing applications under the developer name NextGen Labs.

"NextGen Labs" is a developer identity used for publishing applications through platforms such as the Apple App Store and Google Play. It is not represented as an incorporated company or other separate legal entity.

The developer is based in Algeria.

3. Changes to These Terms

We may update these Terms from time to time to:

• comply with changes in applicable law;
• improve clarity;
• reflect new features or services;
• address security concerns;
• modify subscription offerings;
• improve user protections.

When material changes are made, we will provide reasonable notice through one or more of the following methods:

• an in-app notification;
• our website;
• email (where appropriate).

The "Last Updated" date at the beginning of these Terms indicates when they were most recently revised.

Your continued use of FossilRadar after updated Terms become effective constitutes your acceptance of those revised Terms.

If you do not agree with any updated Terms, you must discontinue use of the Services and delete your account.

4. Eligibility

To use FossilRadar, you must satisfy the following requirements.

Minimum Age

You must be at least 13 years old to create an account or use the Services.

We do not knowingly permit children under the age of 13 to use FossilRadar.

If we discover that an account belongs to a child under 13, we may suspend or permanently delete the account.

Users Under 18

If you are under 18 years of age, you represent that you have obtained permission from your parent or legal guardian before using the Services.

Parents and guardians remain responsible for supervising a minor's use of FossilRadar.

Legal Capacity

By using FossilRadar, you represent and warrant that:

• you have the legal capacity to enter into these Terms;
• all information you provide is accurate;
• you will keep your account information up to date;
• your use of the Services complies with applicable laws.

5. Your Account

Certain features of FossilRadar require a registered account.

These include, but are not limited to:

• saving fossil discoveries;
• cloud synchronization;
• managing collections;
• subscriptions;
• AI identification history;
• hotspot personalization;
• cross-device access.

You may create an account using:

• email and password;
• Google Sign-In;
• Sign in with Apple;
• any additional authentication methods we may support in the future.

You agree to provide accurate, current, and complete information during registration.

You are responsible for maintaining the accuracy of your account information.

6. Account Security

You are responsible for maintaining the confidentiality of your account credentials.

You agree to:

• keep your login credentials secure;
• use a strong password where applicable;
• not share your account with others;
• promptly notify us of any suspected unauthorized access.

You are responsible for all activity occurring under your account unless prohibited by applicable law.

We are not responsible for losses resulting from your failure to adequately protect your account credentials.

7. Acceptable Account Use

Your account is personal to you.

Unless expressly authorized by us, you may not:

• transfer your account to another person;
• sell your account;
• lease your account;
• share premium subscriptions with unauthorized users;
• create accounts using false identities;
• impersonate another person or organization.

We reserve the right to suspend or terminate accounts that violate these Terms.

8. Availability of the Services

We strive to provide reliable and uninterrupted Services.

However, FossilRadar is provided on an "as available" basis.

From time to time, the Services may be unavailable due to:

• maintenance;
• software updates;
• infrastructure failures;
• third-party outages;
• security incidents;
• force majeure events.

We may modify, suspend, replace, or discontinue any feature of FossilRadar at any time.

We will make reasonable efforts to minimize service interruptions but do not guarantee uninterrupted availability.

9. Beta Features

Some features may be identified as:

• Beta;
• Experimental;
• Preview;
• Early Access;
• or similar designations.

These features are provided for evaluation purposes and may:

• change significantly;
• contain bugs;
• produce inaccurate results;
• be discontinued without notice.

Your use of beta features is voluntary and at your own risk.

10. Relationship Between These Terms and the Privacy Policy

Your use of FossilRadar is also governed by our Privacy Policy.

The Privacy Policy explains:

• what information we collect;
• how we use it;
• how we protect it;
• and the privacy rights available to you.

By using the Services, you acknowledge that you have read the Privacy Policy and understand how your information is processed.

If any conflict exists between these Terms and the Privacy Policy regarding privacy matters, the Privacy Policy will govern those specific matters.

11. Description of the Services

FossilRadar is a fossil hunting and educational platform designed to help users discover, identify, organize, and learn about fossils.

Depending on your subscription and device capabilities, the Services may include:

• AI-powered fossil identification;
• fossil collection management;
• geological hotspot maps;
• fossil hunting forecasts;
• educational information about fossils and geology;
• personalized recommendations;
• cloud synchronization;
• premium subscription features;
• push notifications;
• future features introduced by FossilRadar.

We reserve the right to modify, improve, replace, or discontinue any feature at any time.

Certain features may only be available in specific countries, languages, subscription plans, or application versions.

12. Artificial Intelligence Identification

One of FossilRadar's primary features is AI-assisted fossil identification.

When you upload or capture a photograph, FossilRadar uses artificial intelligence models to analyze the image and generate information that may include:

• scientific classification;
• common names;
• geological age;
• geological period;
• taxonomic information;
• rarity estimates;
• confidence scores;
• educational descriptions;
• estimated values;
• suggested identifications.

The AI system continuously evolves as new data and improvements become available.

Accordingly, identification results may differ over time for the same fossil.

13. Educational Purpose

FossilRadar is designed primarily as an educational, research, and recreational tool.

The Services are intended to assist users in learning about fossils and making informed observations.

They are not intended to replace:

• professional paleontological analysis;
• geological surveys;
• museum expertise;
• laboratory examination;
• academic research;
• legal advice;
• professional appraisal services.

Whenever scientific certainty is required, users should consult an appropriately qualified expert.

14. No Guarantee of Accuracy

Although we continually improve FossilRadar, we cannot guarantee that any information provided by the Services is complete, accurate, current, or free from errors.

Artificial intelligence systems are probabilistic and may occasionally produce:

• incorrect identifications;
• incomplete classifications;
• inaccurate confidence scores;
• incorrect geological periods;
• misleading rarity estimates;
• incorrect educational information;
• inaccurate monetary estimates.

Even highly confident AI results may be incorrect.

Users remain solely responsible for independently evaluating information before relying on it.

15. Scientific Disclaimer

FossilRadar does not guarantee that any specimen identified through the Services has been correctly identified.

Scientific identification of fossils often requires examination of characteristics that cannot be reliably determined from photographs alone, including:

• microscopic features;
• internal structures;
• mineral composition;
• preservation state;
• geological context;
• stratigraphic information;
• laboratory analysis.

Accordingly, FossilRadar should not be considered a substitute for professional scientific examination.

16. Estimated Values

Some AI identification results may include estimated rarity or estimated monetary values.

These estimates are provided solely for general informational purposes.

They should not be interpreted as:

• certified appraisals;
• investment advice;
• insurance valuations;
• auction estimates;
• guarantees of market value.

Actual market values depend on numerous factors, including authenticity, preservation, provenance, legality, rarity, market demand, and professional evaluation.

FossilRadar makes no representation regarding the accuracy of estimated values.

17. Geological Forecasts and Hotspot Maps

FossilRadar may generate geological hotspot maps and fossil hunting forecasts using information derived from multiple sources, including geological datasets, environmental conditions, historical fossil occurrences, terrain analysis, and proprietary forecasting algorithms.

These forecasts are intended solely to help users prioritize areas that may warrant further exploration.

They are not guarantees that fossils exist at any location.

A high forecast score does not guarantee fossil discoveries.

Likewise, a low forecast score does not indicate that fossils are absent.

Natural conditions, erosion, weather, land use, and many other factors may significantly affect actual fossil availability.

18. No Permission to Access Land

Displaying a location within FossilRadar does not grant permission to:

• enter private property;
• access restricted land;
• collect fossils;
• excavate;
• conduct geological investigations;
• disturb protected sites.

Users are solely responsible for determining whether they have legal permission to enter any location before visiting it.

You must always respect:

• private property rights;
• national parks;
• protected geological sites;
• archaeological sites;
• nature reserves;
• local regulations;
• government restrictions;
• landowner permissions.

19. Compliance with Fossil Collection Laws

Laws governing fossil collection vary significantly between countries, states, provinces, and municipalities.

Certain fossils may be protected by law.

Some locations prohibit any fossil collection whatsoever.

Others may require permits or landowner permission.

By using FossilRadar, you agree that you are solely responsible for complying with all applicable laws before:

• searching for fossils;
• collecting specimens;
• excavating;
• transporting fossils;
• exporting fossils;
• selling fossils;
• donating fossils.

Nothing within FossilRadar should be interpreted as legal advice or authorization to collect fossils.

20. Outdoor Safety

Fossil hunting often involves outdoor activities that may expose users to hazards.

These hazards may include:

• unstable terrain;
• cliffs;
• rivers;
• coastal erosion;
• caves;
• mines;
• wildlife;
• extreme temperatures;
• floods;
• landslides;
• falling rocks;
• difficult weather conditions;
• remote locations.

You acknowledge that you participate in fossil hunting entirely at your own risk.

You should always:

• use appropriate safety equipment;
• check weather conditions;
• obey warning signs;
• respect restricted areas;
• avoid dangerous locations;
• travel with appropriate preparation.

FossilRadar does not monitor your safety or your location in real time.

21. Assumption of Risk

You understand and agree that any field activities undertaken after using FossilRadar are entirely voluntary.

You assume all risks associated with:

• traveling to forecast locations;
• hiking or climbing;
• fossil collection;
• excavation;
• transportation;
• outdoor exploration;
• environmental hazards;
• interactions with wildlife;
• accidents;
• injuries;
• property damage.

Your decision to visit any location shown in FossilRadar is made independently and entirely at your own discretion.

22. No Emergency Service

FossilRadar is not an emergency service.

The Services are not intended to:

• summon emergency responders;
• monitor your safety;
• provide rescue services;
• replace emergency communications;
• provide medical advice.

Do not rely on FossilRadar during emergencies.

If you require emergency assistance, contact your local emergency services immediately.

23. Future Features

From time to time, we may introduce additional features, including community functionality, educational resources, collaborative tools, AI improvements, or other services.

Unless expressly stated otherwise, those features will also be governed by these Terms.

Some future features may require additional consent, separate agreements, or updated subscription plans.

24. Subscriptions and Premium Services

FossilRadar offers both free and paid subscription plans.

Certain features are available only to users with an active premium subscription.

Premium features may include, among other things:

• unlimited AI fossil identifications;
• advanced geological hotspot forecasts;
• premium forecasting layers;
• enhanced map functionality;
• early access to new features;
• additional cloud storage or future premium capabilities.

The specific features included in each subscription plan may change over time.

25. Subscription Billing

Premium subscriptions are offered as automatically renewing subscriptions unless otherwise stated.

Subscription pricing, billing frequency, and available plans are displayed within the application before purchase.

By purchasing a subscription, you authorize the applicable app marketplace to charge your selected payment method according to its billing terms.

Payments are processed exclusively through:

• Apple App Store; or
• Google Play Store.

FossilRadar does not process or store your payment card information.

26. Automatic Renewal

Unless cancelled before the renewal date, subscriptions automatically renew at the end of each billing period.

The renewal charge will be processed by the applicable app marketplace using your selected payment method.

To avoid renewal, you must cancel your subscription through your Apple App Store or Google Play account before the renewal date.

Deleting the application or deleting your FossilRadar account does not automatically cancel your subscription.

27. Subscription Management

You may manage your subscription at any time through your device's application marketplace.

Depending on your platform, you may:

• upgrade your subscription;
• downgrade your subscription;
• cancel automatic renewal;
• restore purchases;
• review billing history.

Subscription changes become effective according to the billing policies of Apple or Google.

28. Refunds

Purchases made through Apple App Store or Google Play Store are governed by the refund policies of those marketplaces.

FossilRadar does not have the ability to approve, deny, or process refunds for purchases made through those platforms.

Refund requests should be submitted directly to the marketplace through which the purchase was made.

29. Changes to Subscription Plans

We may introduce new subscription plans, modify existing plans, or discontinue certain plans in the future.

Such changes may include:

• pricing;
• available features;
• usage limits;
• subscription durations.

Where required by applicable law or marketplace rules, we will provide notice before material changes become effective.

30. User Content

FossilRadar allows users to create, upload, store, and organize content.

User Content may include:

• fossil photographs;
• collection names;
• descriptions;
• notes;
• profile information;
• identification edits;
• comments;
• other information voluntarily submitted through the Services.

You retain ownership of the intellectual property rights in the content you create.

31. License Granted to FossilRadar

By uploading or submitting User Content, you grant FossilRadar a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to:

• host;
• store;
• reproduce;
• process;
• analyze;
• modify when technically necessary;
• synchronize across devices;
• display;
• transmit;
• back up;
• and otherwise use your content solely for the purpose of operating, improving, securing, and providing the Services.

This license exists only for the purposes of providing FossilRadar and does not transfer ownership of your content.

For content used to improve our artificial intelligence systems, we will use reasonable efforts to process that information in anonymized, aggregated, or pseudonymized form whenever practicable.

32. Your Responsibilities Regarding User Content

You represent and warrant that:

• you own your uploaded content or have the legal right to upload it;
• your content does not infringe another person's intellectual property rights;
• your content complies with applicable law;
• your content is accurate to the best of your knowledge;
• your content does not contain malicious software or harmful code.

You are solely responsible for the content you upload.

33. Prohibited Content

You may not upload, publish, transmit, or otherwise make available content that:

• infringes copyrights, trademarks, patents, or other intellectual property rights;
• is unlawful;
• is fraudulent or deceptive;
• contains malware or malicious code;
• promotes violence or criminal activity;
• contains child exploitation material;
• contains terrorist content;
• violates another person's privacy;
• is defamatory, threatening, or harassing;
• impersonates another individual or organization.

We reserve the right to remove content that violates these Terms or applicable law.

34. Acceptable Use

You agree to use FossilRadar only for lawful purposes.

You agree not to:

• interfere with the operation of the Services;
• misuse the AI identification system;
• disrupt servers or networks;
• attempt unauthorized access;
• exploit security vulnerabilities;
• circumvent subscription restrictions;
• interfere with other users' enjoyment of the Services.

You are responsible for ensuring that your use of FossilRadar complies with applicable laws.

35. Prohibited Activities

Without limiting the foregoing, you agree not to:

• reverse engineer, decompile, or disassemble any part of the Services except where expressly permitted by applicable law;
• copy or reproduce proprietary software or algorithms;
• scrape or systematically extract application data;
• use automated bots to access the Services;
• overload or interfere with our infrastructure;
• attempt to bypass authentication or security controls;
• distribute malware;
• create fake accounts;
• manipulate subscription systems;
• engage in fraudulent activity;
• interfere with the operation of artificial intelligence systems.

36. Artificial Intelligence Abuse

Because AI processing requires significant computing resources, you agree not to intentionally misuse the identification system.

Examples of prohibited conduct include:

• submitting large volumes of automated requests;
• attempting to overload AI services;
• deliberately uploading unrelated or abusive content solely to consume computing resources;
• attempting to manipulate or probe AI models for unauthorized purposes;
• using FossilRadar to develop competing AI identification services through systematic extraction of outputs.

We may limit, suspend, or terminate access to AI features where abuse is detected.

37. Intellectual Property

Except for User Content that you own, FossilRadar and its licensors retain all rights, title, and interest in the Services.

This includes, but is not limited to:

• software;
• application design;
• source code;
• object code;
• graphics;
• icons;
• logos;
• branding;
• trademarks;
• text;
• documentation;
• databases;
• geological scoring methodologies;
• hotspot forecasting algorithms;
• artificial intelligence prompts;
• educational content;
• proprietary datasets;
• compilations;
• and other intellectual property associated with the Services.

No ownership rights are transferred to you through your use of FossilRadar.

38. Limited License to Use the Services

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use FossilRadar solely for your personal, non-commercial use.

This license does not permit you to:

• copy the application;
• modify the application;
• redistribute the application;
• create derivative works;
• resell the Services;
• provide the Services to third parties;
• use FossilRadar for commercial AI identification services without our prior written permission.

All rights not expressly granted remain reserved by FossilRadar.

39. Feedback

If you provide suggestions, ideas, feature requests, bug reports, or other feedback regarding FossilRadar, you grant us the unrestricted right to use that feedback for any purpose without compensation or attribution.

You acknowledge that providing feedback is voluntary and does not create any obligation on our part.

40. Suspension and Termination

We reserve the right to suspend, restrict, or terminate your access to FossilRadar, with or without prior notice, if we reasonably believe that:

• you have violated these Terms;
• you have violated applicable law;
• your account has been used fraudulently;
• your activities threaten the security or stability of the Services;
• you attempt to abuse AI resources or subscription systems;
• you interfere with other users' use of the Services;
• continued access presents legal, security, or operational risks.

Where appropriate and reasonably practicable, we may provide an opportunity to remedy violations before permanently terminating your account.

41. Your Right to Terminate

You may stop using FossilRadar at any time.

You may also permanently delete your account through the application.

Termination of your account ends your right to access the Services.

Account deletion does not automatically cancel an active subscription purchased through the Apple App Store or Google Play Store.

Subscriptions must be cancelled separately through the applicable marketplace.

42. Effect of Termination

Upon termination of your account:

• your license to use the Services immediately ends;
• access to cloud-based features may be revoked;
• your personal information will be handled in accordance with our Privacy Policy;
• premium features may no longer be available;
• certain information may remain in secure backups or where legally required.

Termination does not affect rights or obligations that, by their nature, survive termination.

43. No Warranty

To the fullest extent permitted by applicable law, FossilRadar is provided on an "AS IS" and "AS AVAILABLE" basis.

We make no representations or warranties of any kind, whether express, implied, statutory, or otherwise.

Without limitation, we do not warrant that:

• the Services will always be available;
• the Services will operate without interruption;
• the Services will be error-free;
• defects will always be corrected;
• servers will always be secure;
• the Services will meet every user's expectations;
• AI identification results will be accurate;
• hotspot forecasts will identify fossil locations;
• geological information will always be complete or current.

Your use of the Services is entirely at your own risk.

44. Artificial Intelligence Disclaimer

Artificial intelligence systems are inherently probabilistic.

Accordingly, FossilRadar does not guarantee that AI-generated outputs are:

• scientifically correct;
• complete;
• current;
• suitable for professional use;
• free from hallucinations or inaccuracies.

AI-generated information should always be independently verified before being relied upon for scientific, educational, legal, commercial, or financial purposes.

You acknowledge that all decisions based upon AI-generated information are your sole responsibility.

45. Geological Forecast Disclaimer

Geological hotspot forecasts, environmental scoring, historical occurrence data, and predictive maps are intended solely as decision-support tools.

Forecast scores represent algorithmic estimates based on available data and should not be interpreted as guarantees.

Many factors beyond our control influence fossil discoveries, including:

• erosion;
• weather;
• geological exposure;
• land use;
• excavation history;
• accessibility;
• legal restrictions;
• natural variability.

We make no representation that any location displayed within FossilRadar contains fossils.

46. Outdoor Activity Disclaimer

Fossil hunting involves inherent risks.

These risks include, but are not limited to:

• slips;
• falls;
• unstable terrain;
• rockfalls;
• flooding;
• extreme weather;
• wildlife encounters;
• remote travel;
• drowning;
• vehicle accidents;
• physical injury;
• death.

FossilRadar does not supervise, monitor, or control your outdoor activities.

You voluntarily assume all risks associated with visiting locations suggested by the Services.

47. Limitation of Liability

To the maximum extent permitted by applicable law, FossilRadar, the developer publishing under the name NextGen Labs, and any service providers acting on our behalf shall not be liable for any indirect, incidental, consequential, exemplary, punitive, or special damages arising out of or relating to your use of the Services.

This limitation applies regardless of the legal theory asserted, including contract, tort (including negligence), strict liability, or otherwise.

Without limitation, we shall not be liable for:

• loss of profits;
• loss of business opportunities;
• loss of goodwill;
• loss of revenue;
• loss of data;
• corruption of files;
• interruption of business;
• inaccurate AI identifications;
• inaccurate geological forecasts;
• incorrect estimated fossil values;
• missed fossil discoveries;
• trespassing claims;
• legal penalties arising from fossil collection;
• environmental damage;
• personal injury;
• property damage;
• travel expenses;
• equipment damage;
• any decision made based on information provided by the Services.

Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, our liability will be limited only to the maximum extent permitted by applicable law.

48. Maximum Liability

If, notwithstanding the other provisions of these Terms, FossilRadar is found liable for any claim, our total aggregate liability shall not exceed the greater of:

• the total amount you paid to FossilRadar for premium subscriptions during the twelve (12) months preceding the event giving rise to the claim; or
• USD $100.

This limitation applies regardless of the number of claims asserted.

49. Indemnification

You agree to defend, indemnify, and hold harmless FossilRadar, the developer publishing under the name NextGen Labs, and our service providers, contractors, licensors, and affiliates from and against any claims, liabilities, damages, losses, judgments, settlements, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• your use of the Services;
• your violation of these Terms;
• your violation of applicable laws or regulations;
• your infringement of another person's intellectual property rights;
• your uploaded content;
• your fossil collecting activities;
• your access to private or protected property;
• your misuse of AI-generated information;
• your negligence or intentional misconduct.

This obligation survives termination of your account.

50. Force Majeure

We shall not be liable for any delay, interruption, or failure to perform resulting from circumstances beyond our reasonable control.

Such circumstances may include:

• natural disasters;
• earthquakes;
• floods;
• wildfires;
• epidemics or pandemics;
• war;
• terrorism;
• civil unrest;
• labor disputes;
• internet outages;
• cloud infrastructure failures;
• government actions;
• utility failures;
• cyberattacks;
• failures of third-party service providers.

During such events, our obligations shall be suspended for the duration of the event and for a reasonable recovery period thereafter.

51. Third-Party Services

FossilRadar relies on third-party providers to deliver portions of the Services, including authentication, cloud hosting, artificial intelligence, mapping, analytics, subscriptions, and notifications.

We are not responsible for the availability, content, policies, or practices of third-party services.

Your use of those services may also be governed by their own terms and privacy policies.

52. No Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

Any waiver must be made expressly and in writing.

53. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

The invalid provision shall be interpreted, to the extent possible, in a manner that most closely reflects its original intent while remaining legally enforceable.

54. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws applicable in Algeria, without regard to conflict of law principles.

Nothing in these Terms limits or removes any mandatory consumer rights or legal protections that you may have under the laws of your country of residence.

If mandatory local consumer protection laws provide you with additional rights, those rights remain unaffected by these Terms.

55. Dispute Resolution

We believe most disputes can be resolved quickly through communication.

If you have a concern regarding the Services, you agree to contact us first and make a reasonable effort to resolve the matter informally before initiating formal legal proceedings.

If an informal resolution cannot be reached, disputes shall be resolved in accordance with the applicable laws governing these Terms, unless mandatory consumer protection laws require otherwise.

Nothing in these Terms prevents either party from seeking emergency injunctive or equitable relief where necessary to protect intellectual property, confidential information, or other legal rights.

56. Export Compliance

You agree not to use, export, re-export, or transfer the Services in violation of any applicable export control or trade laws.

You represent that you are not located in, or subject to sanctions imposed by, any jurisdiction where the provision of the Services would be prohibited by applicable law.

You are responsible for complying with all applicable import, export, and trade regulations relating to your use of the Services.

57. Assignment

You may not assign, transfer, sublicense, or otherwise transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations under these Terms in connection with:

• a merger;
• acquisition;
• sale of assets;
